Summary

  • Strengthens public participation requirements for housing element adoption and expands enforcement authority.
  • Public participation requirements:
    • Local governments must make first draft housing element revisions available for public comment for at least 30 days. If comments are received, local governments must take at least 10 business days to consider and incorporate comments before submitting to HCD. HCD is prohibited from reviewing first drafts until the 30-day comment period and 10-day consideration period are completed. For subsequent draft revisions, local governments must post drafts online and email links to individuals and organizations that requested notices at least 7 days before posting.
    • HCD must review and report findings within 90 days of receiving the first draft submittal for each housing element revision, or within 60 days for subsequent draft amendments or adoptions.
  • Expanded enforcement authority:
    • The bill adds the Housing Crisis Act of 2019 and other provisions to the list of laws for which HCD must notify jurisdictions of violations and may notify the Attorney General. HCD is authorized to appoint other counsel to bring enforcement actions if the Attorney General declines to represent the department. The bill establishes a statute of limitations for enforcement actions brought by the Attorney General or HCD.
