Summary

  • Subdivision applicants generally must provide easements of at least 20 feet in width if the subdivider proposes to utilize adjoining property for sewers, drainage, sewer lines, power lines, or other utilities. This law reduces requirements for subdivision permits by allowing boards to accept binding easements of widths less than twenty (20) feet if the subdivider demonstrates that the easement is adequate to protect the safety and health of the public and provides adequate access for the maintenance of the facilities.
