Summary
- Requires a governing body to create a program expediting the process for issuing residential building permits based on a preliminary plat and to issue the number or percentage of permits requested by an applicant.
- The program is to be created by October 1, 2024.
- Applies to counties with 75,000+ residents.
- Applies to municipalities with 10,000+ residents or 25+ acres of land designated as agricultural or to be developed as residential.
- Requires the expedited process to include an application allowing the applicant to identify the percentage of planned homes (not to exceed 50%) or number of building permits the governing body must issue.
- The application or final approval may not alter or restrict the number requested.
- However, it does not restrict the governing body from issuing permits for more than 50%.
- Requires any governing body with an existing expedited permit program as on July 1, 2023, to update it to approve written applications for issuing up to 50% of building permits.

- Allows an applicant to use a private provider to expedite building-permit applications after approval of the preliminary plat.
- Allows an applicant to contract to sell but prohibits transferring ownership or obtaining any certificate of occupancy until the final plat is approved and recorded.
- Provides that vested rights may be formed in a preliminary plat, under certain circumstances.
