Summary
- Maintains providing a 50% reduction in school facilities surcharge for multifamily housing in transit district overlay zones or within one-quarter mile of Metro/MARC stations.
- Studio and efficiency units are exempt from the school facilities surcharge within the same transit-related areas, in addition to Regional Transit Districts or Local Centers (Growth Policy areas) under Plan 2035.
- Prince George’s County may further reduce the surcharge by up to 50% for multifamily units located within ¼ mile of a Purple Line station, or in areas without an approved TDOZ.
- Extends to December 1, 2026 the deadline for Prince George’s County to:
- Review and recommend changes to the school facilities surcharge and public safety surcharge.
- Evaluate whether changes to these surcharges could positively impact the ability to construct and maintain affordable housing.
- Report findings to the County Council, School Board, and County Delegation.
- Extends the expiration date for surcharge-related provisions (Sections 2 & 3 of HB 225 of 2019) from June 30, 2024 to June 30, 2029, thereby maintaining the following for an additional five years:
- Reduced surcharge rates
- Unit exemptions
- Study requirements related to affordable housing impacts
