Summary

  • Adds to the definition of affordable housing to include “the costs of any required parking, maintenance or landlord-imposed fees,” in the case of a dwelling unit for rent.
  • Defines “exempt local government” to mean any local government in which at least 10% of its total year-round housing units are affordable, or any municipality with a population under 1,000.
  • Defines “housing organization” as a trade or industry group engaged in the construction or management of housing units.
  • Adds requirement for what the affordable housing plan under this act should include: a description of any housing market conditions, infrastructure limitations, local government ordinances–including zoning and land use ordinances–local gov’t policies or practices that don’t affirmatively further fair housing, and other factors that may constrain the local gov’t’s ability to create and preserve affordable housing.
  • Each affordable housing plan submitted by a local government will be posted on the Illinois housing development authority’s website.
  • Grants rights to file an appeal to the state housing appeals board against a non-exempt municipality if a proposed affordable housing development was denied by the municipality to affordable housing developers/developments, people who would be eligible to apply for residency in a development, or a housing organization whose geographic focus area includes the municipality where the provided affordable housing development is located beginning January 1, 2026.
