Summary

  • Authorizes municipalities to create a brownfield redevelopment authority to implement brownfield plans. Creates Transformational Brownfield Plans, allowing a developer to capture property taxes to finance large-scale, mixed-use redevelopment projects of certain property, including, but not limited to, tax reverted, blighted or functionally obsolete property.
  • Increases the availability of housing through partnerships that support housing development, redevelopment of blighted properties, and neighborhood revitalization, as well as encourages collaborations between land banks and nonprofit or for-profit housing developers.
  • The bill allows land banks to quickly enter into development agreements and work with developers, nonprofits, or other entities to facilitate housing projects. Specifically, it allows land banks to convey property or enter into development agreements with entities focused on housing development and reuse instead of only with external housing developers or nonprofits.
  • The land applies to land bank fast track authorities established under the Land Bank Fast Track Act (2003 PA 258).
  • “Blighted” properties are defined as properties that have been declared a public nuisance in accordance with a local housing, building, plumbing, fire, or other related code or ordinance; is an attractive nuisance to children because of its physical condition, use, or occupancy; utilities are permanently disconnected or destroyed; is tax reverted property  owned by a qualified local governmental unit; or owned by or under the control of a land bank fast track authority; or has a substantial buried subsurface demolition debris present.
