Summary
- This act revises the Sanitation in Subdivisions Act application review process. It allows an independent reviewer to conduct subdivision reviews under certain circumstances.
- It establishes triggers for independent reviews, requires reporting to the environmental quality council, and requires the department of environmental quality to develop a curriculum and examination to certify independent reviewers.
- It requires refunds of subdivision fees for deadline extensions requested by the department of environmental quality.
- Before July 1, 2028, the department shall provide a comprehensive review of subdivision review procedures, including an analysis of the role of independent reviewers, delays in permit issuance, and permit outcomes. The act is nonseverable so that if one part is held unconstitutional or invalid, all other parts are invalid. The act applies to applications received on or after January 1, 2024.
