Summary

  • Defines “Impact fees” as fees imposed by counties, municipalities, and some special districts to fund local infrastructure needed to expand local services to meet the demands of population growth caused by development.
  • Limits municipalities’ ability to increase impact fees.
    • Fee increases not exceeding 50% of current impact fee rate; and not more than once every four years.
      • Unless a municipality completes a demonstrated-need study justifying the increase in extraordinary circumstances and adopts the increase by a 2/3rds vote.
    • Impact fees < 25% implemented in 2 annual increments; 25–50% in 4 increments.
  • Defines the terms “infrastructure” and “public facilities” as used by impact fee statutes so that they may be utilized only for fixed capital expenditures or fixed capital outlays for major capital improvements;
  • Requires special districts, in addition to local governments, to issue dollar-for-dollar impact fee credits in exchange for other exactions.
  • Applies starting January 1, 2021.
