Section 1: Establishes Oregon Housing Needs Analysis in the Oregon Department of Administrative Services. Outlines the components of the housing needs analysis
Section 2: Outlines the annual statewide housing analysis component, which estimates factors including projected needed housing units, current housing underproduction, housing units needed for people experiencing homelessness, and housing units projected to be converted into vacation homes or second homes.
Section 2 (Allocated Need): Outlines the allocated housing need component, in which the Department allocates housing needs for each city for different income levels based on factors such as the statewide analysis and population forecasts.
Section 3: Outlines the housing production targets component, in which the Department will allocate housing production targets, including an affordable housing target for households making less than 80 percent of area median income, to each city and urban area within the Metro urban growth boundary.
Section 4 and 5: Requires the Housing and Community Services Department to develop housing production dashboard and housing equity indicators.
Section 13: Requires local governments to inventory buildable lands to meet housing production targets, and take actions such as amend comprehensive plan or land use regulations if housing production target is greater than development-ready lands.
Section 14: Allows the Department of Land Conservation and Development to audit, and to enter into housing acceleration agreements with, certain cities that are not adopting or implementing housing production strategies or that are lowest performing as measured by dashboard and indicators.
Requires the Department to provide under the housing acceleration agreement: technical assistance, specific funding, and assistance in pursuing under funds, and amend the city's housing production strategy if the department determines factors affecting housing production are directly within a city’s control.
Section 16 and 17: Allows the Department of Land Conservation and Development to seek, and Land Conservation and Development Commission to issue, specific enforcement orders for certain continued noncompliance by cities in addressing housing.
Section 21: Requires urban cities outside of Metro to periodically determine its needed housing, inventory supply of buildable lands, and take actions to accommodate needed housing.
Section 23: Defines needed housing for urban cities outside of Metro as housing by affordability level, type, characteristics and location that is necessary to accommodate the city’s allocated housing need over the 20-year planning period, and includes detached single-family housing, middle housing, multifamily housing, government assisted housing, and other types of housing.
Section 22: Requires urban cities outside of Metro to amend its urban growth boundary to include sufficient buildable lands, amend comprehensive plan or land use regulations, and other actions if needed housing is greater than the city’s housing capacity.
Section 24: Allows cities outside of Metro to adopt rural reserves within the urban growth boundary.
Section 27: Expands the definition of needed housing for the Metro to include housing for individuals with disabilities, older persons and college or university students, and requires the Metro to allocate a housing need for each city in the Metro.
Section 28: Expands actions that can be included in a city’s housing production strategy, to include actions such as preparing land for development or redevelopment, actions that increase housing diversity, efficiency and affordability, actions that affirmatively further fair housing, among other actions.
Section 30: Requires the Metro to develop and adopt a housing coordination strategy, which must include a list of actions to promote the development of needed housing, the development and maintenance of housing of diverse housing, housing with access to economic opportunities, and development patterns that replace segregated housing patterns.
Section 35: Requires cities with a population of 10,000 or greater to submit annual housing reports to the Department of Land Conservation and Development, a report with information on the number of residential units by type.
Section 47: Requires the Housing and Community Services Department to provide grants or loans for modular housing and components. Sunsets January 2, 2026.
Section 50: Requires the Oregon Facilities Authority to provide financing for infrastructure and predevelopment costs for moderate income housing. Sunsets January 2, 2026.
Additional Provisions: Other sections include additional tenant protections for nonpayment of rent, expands eligibility of emergency housing assistance, and appropriates money for purposes of the Act.
