Summary
- Provides a procedure for extending or amending deed restrictions for certain older subdivisions in municipalities with a population of two million or more (Houston), which had original restrictions that did not have an express procedure providing for successive extensions of the restrictions, did not have an express procedure for amending the restrictions, could not be amended without unanimous consent of all owners, or may no longer be valid.
- Prohibits the creation of property owners’ associations with mandatory membership through the amendment of restrictions under the act.
- Reiterates that provisions in restrictions extended under the act that are void and unenforceable under the United States Constitution or state law, such as race-related covenants, are considered as if they were never contained in the restrictions.
