Summary
- Requires short-term rental unit provider to maintain a certain amount of insurance and comply with fire sprinkler and alarm standards.
- Prohibits municipalities from: enacting short-term rental bans or restricting the use of short-term rental units.
- Exempts short-term rentals from being subject to the same regulatory requirements as hotels under Hotel and Swimming Pool Inspection Act except for occupancy taxes.
- Defines short-term rental as a dwelling with a rental period of less than 30 days.
- Reserves local municipalities’ authority to regulate property containing short-term rentals so long as the purpose of the local law is to protect public safety and health.
- Reserves local municipalities’ authority to regulate land use of properties containing short-term rentals so long as short-term rental properties are regulated in the same manner as other residential dwellings.
- Subjects short-term rental owners, but not marketplaces, to business taxes at the same amount and manner for hotel operators.
- Allows marketplaces and/or property managers to remit sale / use tax.
