Summary
- Section 83 provides that the department of energy resources establish a demonstration project in which localities can adopt or amend zoning ordinances that require new building construction or major renovation projects to be fossil fuel-free. Participating localities can also restrict or prohibit new building construction and major renovation projects that are not fossil fuel-free. To be eligible, a city or town must have either:
- Met the 10% affordability threshold of 40B or obtained safe harbor through a Housing Production Plan; or
- Approved a zoning ordinance or by-law that provides for at least 1 district of reasonable size in which multi-family housing is permitted as of right; such housing may not have age restrictions and must be suitable for families with children.
