Summary
- Amends Government Code 65852.2 to bar a local agency from requiring owner-occupancy as an ADU standards, except that it may require the rental to be 30 days or longer.
- Adds that in addition to local agencies requirement to allow the separate sale of an ADU, a local agency may also adopt an ordinance allowing the primary dwelling unit and one or more accessory dwelling units to be separately conveyed as condominiums. Any such ordinance must:
- Be created in accordance with Davis-Stirling Common Interest Development Act;
- comply with all requirements of the Subdivision Map Act and any local subdivision ordinances;
- Require safety inspections of ADUs to become a condo;
- Require all lienholders to provides written consent;
- Provide condo conversion information on all materials to ADU residents;
- Require all ADU condo conversions to be reported to utility companies;
- Require association’s express written approval if part of an existing planned development.
- These amendments were incorporated into this bill and AB 1033, both came into effect.
