Summary
- Requires public agencies to administer programs and activities related to housing and community development in a manner to affirmatively further fair housing, defined as taking actions that overcome patterns of segregation and foster inclusive communities free from barriers that restrict access to opportunity based on protected characteristics, to be interpreted consistent with the Affirmatively Furthering Fair Housing Final Rule dated July 15, 2015 regardless of of subsequent amendment, suspension, or revocation.
- Requires local planning agencies to promote and affirmatively further fair housing opportunities for all persons regardless of protected characteristics, as enumerated in the California Fair Employment and Housing Act, when identifying actions in their housing elements and to include an assessment of fair housing in their jurisdiction within their housing elements. Applies to housing element revisions occurring on and after January 1, 2021.
- Requires local jurisdictions to affirmatively further fair housing in compiling an inventory of land suitable for residential development as part of their housing elements.
