Summary
- Clarifies that an accessory dwelling unit can be located in an accessory structure or be detached from the primary dwelling, as long as it is on the same lot as the proposed or existing primary dwelling, including detached garages.
- Edits the language to require a local agency to “approve or deny” a permit application, rather than simply “act upon” it.
- If a permitting agency denies an application for an ADU, it must, within the required time period, give the applicant written feedback explaining what is wrong or missing in the application and how the applicant can fix those issues.
- Defines ‘permitting agency’ as an entity involved in reviewing a permit necessary for an ADU, and for which there is no substitute.
