Summary
- Prohibits use of state funds for predevelopment, development, or operation of housing for H-2A workers; requires reimbursement of any state funds improperly used for this purpose, with an exemption for contracts entered before January 1, 2020.
- Grants tenants in agricultural employee housing all rights applicable to employee housing residents, including fair housing and tenant protection rights.
- Creates a streamlined, ministerial approval process for agricultural employee housing on agriculturally zoned land, exempt from CEQA, if the development consists of no more than 36 beds in group quarters or 12 units for single-family use, is operated by a certified affordable housing organization, and is subject to a recorded 35-year affordability covenant.
- Requires local governments to provide written findings of noncompliance within 30 days for developments of 50 or fewer units and 60 days for larger developments; developments not receiving timely findings are deemed compliant.
- Allows local governments to impose objective development standards and fees essential to public services, but prohibits discretionary zoning requirements; designates approvals as non-discretionary under CEQA.
- Requires landowners to select a replacement certified operator within 90 days if the original operator ceases, subject to administrative penalties for failure to do so.
- Requires HCD to establish a certification process for affordable housing organizations qualified to operate agricultural employee housing, limited to nonprofits and local public housing agencies with demonstrated California experience.
