Summary
- AB 1505 authorizes cities and counties to adopt ordinances requiring residential developments, as a condition of approval, to provide a percentage of units affordable to households at designated income levels. Ordinances must include alternative means of compliance, such as in-lieu fees, land dedication, off-site construction, or acquisition and rehabilitation of existing units.
- The Department of Housing and Community Development may request an economic feasibility study if a jurisdiction has failed to produce at least 75 percent of its regional housing need or failed to submit its housing element report for two consecutive years. The Department may require modification only for ordinances mandating more than 15 percent of rental units be affordable to households earning no more than 80 percent of area median income, limiting the requirement to 15 percent.
- Feasibility studies must be prepared by individuals with demonstrated economic expertise, be publicly available for at least 30 days, and use rigorous, accepted methodologies. State review authority applies only to ordinances adopted or amended within ten years of the bill’s effective date.
