  • Strengthens requirements for local governments to affirmatively further fair housing (AFFH) in their housing elements:
  • Clarifies that public agencies have a mandatory duty to affirmatively further fair housing in programs and activities relating to housing and community development. Specifies this is a clarification of existing law, not a change.
  • Enhanced housing element analysis requirements:
    • Site inventory: Requires the inventory of land suitable and available for residential development to include analysis of:
      • Relationship of identified sites to the jurisdiction’s AFFH duty
      • Whether the inventory of housing types (multifamily rental, factory-built, mobile homes, agricultural employee housing, supportive housing, SROs, emergency shelters, transitional housing) affirmatively furthers fair housing
    • Fair housing assessment: Expands required analysis of fair housing issues to include:
      • Integration and segregation patterns and trends using federal, state, and local data
      • Fair housing enforcement and outreach capacity
      • Local and regional historical origins of fair housing issues
      • Current policies and practices contributing to fair housing factors identified
  • Program actions: Requires the schedule of actions to identify sites and actions needed to affirmatively further fair housing.
