Summary
- Defines subject and supportive jurisdictions. Subject jurisdictions include: (1) municipalities with populations of 1,000+ located within a metropolitan planning organization (MPO); or (2) portions of counties within a census-designated place of 40,000+ people and within an MPO. Beginning June 30, 2025, subject jurisdictions must allow one accessory dwelling unit (ADU), through an administrative approval process, as an accessory use to any single-unit detached dwelling where such dwellings are permitted.
- Limits local restrictions on ADUs. Prohibits subject jurisdictions, on or after June 30, 2025, from enacting or enforcing local laws or practices that restrict ADU construction or conversion.
- Establishes criteria for supportive jurisdictions. To qualify, a local government must submit a report to the Department of Local Affairs by June 30, 2025, demonstrating compliance with ADU requirements (as a subject jurisdiction or as if it were one) and implementation of one or more specified strategies to encourage ADU development.
- Creates an ADU fee reduction and encouragement grant program. Provides grants to supportive jurisdictions to offset costs for pre-approved ADU plans, technical assistance, and waiving, reducing, or subsidizing ADU-related fees and required costs.
- Directs development of model public safety codes. Requires the department to create, and local governments to consider and adopt, model public safety code requirements addressing geographic and climatic conditions for factory-built structures, including ADUs.
- Authorizes $8 million for ADU support programs. Empowers the Colorado Economic Development Commission to contract with the Colorado Housing and Finance Authority to operate programs benefiting low- to moderate-income residents of supportive jurisdictions.
- Preempts stricter ADU limits in planned unit developments. Prohibits planned unit development ordinances from restricting ADU permitting more than the jurisdiction’s general ADU regulations.
