Summary
- Requires local governments to approve qualifying housing developments as a use by right on any land owned by an independent institution of higher education or a religious institution on or before January 1, 2024 through a streamlined, ministerial process.
- Requires that 100% of the units are affordable to lower income households, except that 20% may be moderate income-households, and 5% of the units may be for staff of the institution. Amounts set should consist with the established California Tax Credit Allocation Committee.
- Specifies that a housing development project that is eligible for approval as a use by right under the bill is also eligible for a density bonus, incentives, or concessions, or waivers or reductions of development and parking standards.
- Requires written notice of conflicts to developer within a set timeframe, and if no notice is provided project is deemed compliant
- Sunsets the statute as of January 1, 2036.
