Summary

  • Requires specified municipalities and counties to include a moderate income housing element that provides a realistic opportunity to meet the need for additional moderate income housing within the next five years and selects three or more moderate housing strategies for implementation (municipalities with a fixed guideway public transit station must select at least four strategies).
    • The sections also identify additional moderate income housing strategies for selection by municipalities and counties, including:
      • Creating landlord incentive programs.
        • Establishing housing and transit reinvestments zones.
        • Eliminating impact fees for accessory dwelling units.
        • Transferring development rights for moderate income housing.
        • Developing moderate income housing projects for residents who are disabled or older than 54 years old.
        • Reducing regulations related to multifamily residential dwellings.
    • Requires municipalities with fixed guideway public transit stations to develop station plans that outline a vision of development for the area around a station. Among other objectives, station area plans must promote increasing the availability and affordability of housing, including moderate income housing.
    • Requires local governments to include in their moderate income housing reports a description of strategies selected for implementation, along with an implementation plan, as well as annual progress made in implementation.
    • Prohibits impact fees on internal accessory dwelling units.
    • Outlines requirements for an eligible voter to submit a transit area land use law to a referendum.
    • Prohibits referenda on transit area land use laws passed by a two-thirds vote of the local legislative body.
    • Creates a Rural Housing Fund to provide loans in certain counties and municipalities to projects that include moderate income housing units and have been approved by the Housing Loan Fund Board.
    • Appropriates funds for the Division of Housing and Community Development to develop a statewide database for moderate income housing units.
    • Appropriates funds for the Section 8 Landlord Incentive Program.
    • Appropriates funds for a nonprofit entity engaging in efforts to increase housing affordability through local zoning and housing regulation reform.
