Summary
- Allows local governments to require the development of a certain number of moderate income housing units as a condition of approval of a land use application only if:
- The municipality or county and applicant enter into a written agreement regarding the number of moderate income housing units or the municipality provides incentives for the development of moderate income housing units.
- Prohibits local governments from considering an applicant’s decision not to participate in the development of moderate income housing in evaluating a land use application.
