Summary
- Directs local governments to respect timeframes for issuance of certificates of occupancy/completion for various permits (otherwise they are automatically deemed issued).
- Limits local governments to three requests for additional information from an applicant applying for certain types of building permits
- Requires local governments to review requested additional information within specified time periods (waivable):
- Review within 15 days if the applicant submits it within 30 days of the initial request.
- Review within 10 days if the applicant submits information within 30 days of a second request for additional information.
- Allow an in-person review rather than a third request for information; otherwise a 10-day review period applies if applicant submits information within 30 days.
- Restricts local governments from limiting/prohibiting private property owners from obtaining building permits to demolish single-family residential structures located in flood hazard areas.
- Restricts local governments from imposing additional regulatory requirements on the replacement of these demolished structures not otherwise applicable to similarly situated parcels (with exceptions to this provision for certain historic buildings).
- Provides a cause of action for certain owners/builders to enforce statutory provisions limiting the uses of a local government’s excess Building Code enforcement funds.
