Summary

  • Extends the Housing Crisis Act of 2019 to January 1, 2030, and authorizes the department to update the list of affected cities and counties a second time on or after January 1, 2025. Clarifies that “housing development project” includes projects with no discretionary approvals, mixed discretionary and nondiscretionary approvals, and single dwelling units (declaratory of existing law, except for projects with applications submitted before January 1, 2022).
  • Allows local agencies to apply ordinances, policies, and standards adopted after preliminary application submission to housing projects that have not commenced construction within 2.5 years of approval, or 3.5 years for affordable housing projects. Clarifies that prohibitions on reducing land use intensity apply to designations and zoning districts in effect at the time of the proposed change.
  • Defines “concurrently” for no net loss requirements as actions approved at the same legislative body meeting, or within 180 days if requested by an applicant for a housing development project. For initiative measures, concurrent means the action is included in the initiative so added residential capacity becomes effective simultaneously with any reduction.
  • Limits relocation benefits and right of first refusal requirements to occupants of protected units who are lower income households, excluding short-term rentals under 30 days. Exempts single residential unit projects replacing a single protected unit and developments with 100% lower income units from right of first refusal requirements, unless the existing occupant qualifies for residence and is not precluded by unit size or funding source requirements.
