Summary
- Authorizes local government units (including counties; cities; sanitary districts; water and sewer authorities; metropolitan water and sewerage districts; and county water and sewer districts) to impose a system development fee for water and sewer service.
- Defines a system development fee as a charge for services imposed with respect to new development to either fund the cost of capital improvements required by the new development, recoup the costs of existing facilities serving the new development, or both fund and recoup costs.
- Requires the system development fee to be calculated based on written analysis prepared by a qualified professional using a listed eligible methodology that covers a planning horizon between 10 and 20 years; limits the system development fee to that calculated in the written analysis.
- Provides additional details about the implementation of local system development fees, including clarification of a three year statute of limitations for recovery of an unlawfully imposed fee, charge, or exaction.
