Summary
- Updates the requirements for a condominium association filing a construction defect claim.
- Condominium associations must include a written report from a construction defect professional in the written notice of claim.
- Responding construction professionals may demand and hold a meeting with the claimant and the expert within 14 days of service.
- Creates the down payment assistance account to fund down payment assistance loans offered by the Washington State Housing Finance Commission (HFC). The account is funded by the lesser of either all real estate excise tax revenue collected in the prior year from sales of condominiums or townhouses to persons using down payment assistance loans offered by the HFC, or $250,000.
- Mandates that impact fee schedules must reflect the proportionate impact of new housing units, in order to produce a proportionally lower impact fee for smaller housing units.
- Requires that jurisdictions must adopt the section’s requirements to take effect six months after the next required periodic comprehensive plan update.
- Requires cities and municipalities to include procedures for unit lot subdivisions allowing division of a parent lot into separately owned unit lots in their short plat regulations. Portions of the parent lot not subdivided for individual unit lots must be owned in common by the owners of the individual lots or by a homeowners’ association comprised of the owners.
