Summary
- Prohibits local governments from adopting or enforcing zoning decisions, ordinances, regulations, restrictions, or conditions on new manufactured homes replacing preexisting manufactured homes or mobile homes within a manufactured home community, mobile home park, or any other residential land, that would prevent the property owner’s continuing lawful, nonconforming use.
- Provides that the prohibition does not apply for discontinuances necessary for the safety of life or property, nonconforming uses that have been discontinued for more than 12 months, replacement homes that would change from the lawful nonconforming use as a single-family dwelling to any other type of dwelling, and replacement homes that obstruct a shared driveway or sidewalk.
