Summary

  • Restricts the circumstances under which a court can order a person’s primary residence be sold due to unpaid debt.
  • Require localities to incorporate into their comprehensive plans strategies to promote manufactured housing as a source of affordable housing, through strategies such as the preservation of existing manufactured housing communities, the creation of new manufactured home communities, and the creation of new manufactured home subdivisions.
  • Requires the Director of Housing and Community Development to develop a statement of tenant rights and responsibilities under the Virginia Manufactured Home Lot Rental Act.
  • Prevents trustees of residential real estate from selling the property in the case of a foreclosure sale without an affidavit, in the case where residential real estate is in the name of a neutral trustee and not the borrower of the mortgage. Increases the notice period for a foreclosure sale and requires such notice to provide the grantor with certain information,in the case of a deed of trust conveying owner-occupied residential real estate.
  • Requires the landlord of a manufactured home park to provide tenants who own their manufactured home certain information.
