Summary
- Defines ‘livable space’ as a dwelling intended for human habitation.
- Clarifies that the prohibition on replacement parking requirements applies to uncovered parking spaces, in addition to garages, carports, and covered parking structures, when such parking is demolished or converted in connection with ADU construction.
- Amends Government Code Section 66323 to replace the prior limit of “no more than two” detached ADUs on multifamily lots with a framework allowing multiple detached ADUs, permitting up to eight detached ADUs on lots with existing multifamily dwellings (but not more than the number of existing units on the lot) and up to two detached ADUs on lots with proposed multifamily dwellings.
- Clarifies that if an ADU meets the requirement in the original text, the local government cannot apply any additional design standards beyond what this section already allows.
- Adds that reimbursement by the state for this law is not required as localities can levy service charges and fees.
