Summary

  • Transfers $331M from the General Fund to the National Mortgage Special Deposit Fund and appropriates $100,000 to the Department of Finance to study establishment of a trust to manage those funds.
  • Changes the Attorney General’s obligation to request court orders directing housing element compliance from mandatory to discretionary, and provides that a court determination of substantial compliance carries the same effect as an HCD determination for purposes of financial assistance eligibility and prohousing incentives.li>
  • Limits HCD’s obligations to offer meetings and de novo review to jurisdictions that would be denied funding under programs requiring a substantially compliant housing element and under which the jurisdiction previously applied; extends HCD’s deadline to issue written findings from 30 to 90 days.
  • Adds the Council of San Benito County Governments to the central coast multiagency working group and authorizes councils of governments to request up to 25% of available Local Government Planning Support Grant funds in advance, with HCD required to award those funds within 30 days.
