Summary
- Curbs unnecessary appeals of land use cases by requiring any party that appeals the Circuit Court’s final decision in land use cases to file an appeal bond.
- Requires the Circuit Court to conduct a hearing to determine the amount of appeal bond and issue findings of fact within 30 days of an appellant filing a motion to post an appeal bond.
- Provides that the Circuit Court can determine that an appeal is presumptively frivolous, and increase the bond amount if determined to be frivolous.
- Requires appellants to post an appeal bond within 15 days of the Circuit Court’s determination of the bond amount, otherwise the appeal is dismissed.
- The bill does not apply to The United States, Commonwealth of Kentucky or its municipal corporations or political subdivisions, Agencies or officers acting on behalf of the above, and Persons challenging the creation or expansion of a landfill.
