Summary
- Changes the threshold for planning board approval of any land development or subdivision application from a majority of the full membership to a majority of planning board members present at the time of the vote.
- Provides that a minimum of four members (including alternates) of a zoning board of review will constitute a quorum.
- Provides that a minimum of four and a maximum of five active zoning board members, including alternates, are entitled to vote on any issue. Also provides that a majority of voting members are needed to either 1) reverse any order, requirement, decision, or determination of any zoning administrative officer from whom an appeal was taken; or 2) decide in favor of an applicant on any matter within the discretion of the board upon which it is required to pass under the ordinance, including variances and special-use permits.
- States that five active members (which may include an alternate) of the state housing appeals board (SHAB) are necessary to conduct a hearing on an appeal. SHAB shall render a decision based upon a majority vote of members present and voting.
