Summary
- Provides uniform zoning standards for accessory dwelling units (ADUs) and amends the definition of ADUs.
- Clarifies that ADUs meeting necessary design and use standards are permitted as of right in all residential zoning districts and shall be permitted through an administrative building permit process only.
- Promulgates use standards about lots that are eligible for ADUs and the ADU footprint that municipalities must allow.
- Prohibits municipalities from a range of activities, including charging ADU permitting fees that would exceed those charged for a new single-family dwelling, requiring certain infrastructure improvements in connection with the ADU, requiring more than one off-street parking space per ADU bedroom, or limiting ADUs to lots with existing dwellings. Also prohibits ADUs from being offered or rented for transient use through a hosting platform.
- Requires that ADUs not allowed by right shall not be reviewed as a minor or major land development project. Also requires that municipalities allow ADUs as part of applications for new primary dwelling units or subdivisions.
- Allows municipalities to utilize a unified development review process for any application that includes ADUs and to exempt ADUs from utility assessment and/or tie in fees.
