Summary
- Prohibits local agencies from imposing affordable housing impact fees, including inclusionary zoning fees and in-lieu fees, on affordable units within housing developments. Affordable housing impact fees are charges levied on new development to fund affordable housing programs or to satisfy inclusionary housing requirements through payment rather than construction of affordable units.
- Applies to affordable units for very low income, low-income, moderate-income households, and qualifying residents including lower income students. Amends the Density Bonus Law, which requires cities and counties to provide density bonuses and other incentives to developers who include specified percentages of affordable units in their projects.
