Summary

  • Removes requirement that emergency shelters only be subject to the development and management standards that apply to residential or commercial development within the same zone;
  • Maintains the requirement that local jurisdictions only subject emergency shelters to specified written, objective standards; and
  • Requires that local jurisdictions include within zoning designations that allow for emergency shelters sites that meet at least one of the following standards:
    • Vacant sites zoned for residential use,
    • Vacant sites zoned for nonresidential use that allow residential development and are located near amenities and services for people experiencing homelessness,
    • Nonvacant sites that allow residential development that are suitable for use as a shelter within the current planning period;
  • Requires that local jurisdictions have sufficient sites to accommodate the need for shelters, with a minimum of 200 square feet per person at each site unless the local jurisdiction can demonstrate that the site can accommodate more people; and
  • Allows local jurisdictions to accommodate the need for emergency shelters on sites owned by the local government if they demonstrate with substantial evidence that such sites will be available during the planning period, are suitable for residential use, and are located near amenities and services for people experiencing homelessness.
  • Requires local governments to ensure that their housing element inventories can accommodate remaining unaccommodated portions of the regional housing need from the prior planning period in addition to the current planning period.
