Summary
- Prohibits local agencies from requiring the replacement of religious-use parking spaces that a developer of a religious institution affiliated housing development project requests to eliminate, provided that the eliminated spaces do not exceed half of the number available at the time of the request.
- Prohibiting local agencies from conditioning approval of a religious institution affiliated housing development project on the curing of a preexisting deficit of religious-use parking spaces.
- Requires local agencies to count religious-use parking spaces available after completion of a religious institution affiliated housing development toward the parking requirement needed for approval.
- Prohibits local agencies from denying approval of a religious institution affiliated housing development project on the basis that it will reduce the total number of parking spaces available at the place of worship as long as the reduction does not exceed half of existing spaces.
- Authorizes local agencies to require a maximum of one parking space per unit for a religious institution affiliated housing development project unless the parcel is within one-half mile of public transit or is located within one block of a car share vehicle.
