Summary
- Requires cities and counties to provide an 80% density bonus to developers constructing housing developments where 100% of units (excluding managers’ units) serve lower-income households, with up to 20% of units permitted for moderate-income households.
- Qualifying developments receive 4 incentives or concessions, a height increase of up to 3 stories or 33 feet if within ½ mile of a major transit stop, and a full exemption from maximum density controls if within ½ mile of a major transit stop.
- Developments receiving a density controls waiver may not also seek waivers or reductions of development standards under existing Density Bonus Law, except as expressly provided.
- Requires rent for at least 20% of units to be set at affordable rent; remaining units must be set at levels consistent with state or federal low-income housing tax credit maximums.
- Prohibits any minimum vehicular parking requirement for developments consisting solely of lower-income rental units that qualify as special needs or supportive housing.
