Summary
- Allows municipalities to create a voluntary “attainable housing” incentive program for the development of multi-family housing or facilities through legislation.
- Defines “multi-family housing” as housing accommodations that are designed principally for residential use and consist of not less than five rental units on one site, so long as such units are not detached.
- Requires ordinances creating an attainable housing incentive program to:
- define “attainable housing,”
- the sorts of buildings eligible for the program,
- the geographic areas eligible for the program,
- any exceptions or conditional uses included in the zoning ordinances of the municipality,
- other municipal incentives available to property owners.
- Requires regional or municipal planning commission staff to review applications to these incentive programs and make final determination whether to approve or reject at the next public meeting held after the completed application.
- Requires housing constructed under this program to be deed-restricted in order to be attainable in perpetuity.
- Clarifies that while TN prohibits mandatory municipal rent control, this does not preempt voluntary incentive programs to create units that rent or sell at below market rate.
