Summary
- Amends Section 714.6 of the Civil Code,
- Allowing affordable housing developers, who own property subject to an unenforceable restrictive covenant concerning the number, size, or location of residences on the property or the number of persons who may reside on the property, to provide notice via mail or publication to anyone known to have an interest in the property or in the restrictive covenant when informed of the recording of an affordable housing modification document on such property;
- Prohibiting owners of property from recording affordable housing modification documents until they closes escrow on the property and become record title owner; and
- Requiring any party seeking to challenge the validity of a restrictive covenant affordable housing modification document to file suit within 35 days of receiving optional notice from the owner of the property subject to the restrictive covenant.
