Summary
- Creates Approved Monitoring Agent Program and directs the Rhode Island Housing Resources Commission to promulgate rules and regulations for the implementation of the program, including a process for selecting and approving monitoring agents.
- Monitoring agents’ duties include:
- Ensuring that tenants in low- and moderate-income (LMI) housing meet income limits annually and that monthly rental rates are consistent with both LMI guidelines and recorded deed restrictions.
- Ensuring that LMI homeownership units serve as the owners’ year-round principal residents and that any proposed refinance of a LMI unit while a deed restriction is in effect complies with program requirements.
- Ensuring that any LMI accessory dwelling unit being counted complies with requirements, including an annual lease, occupancy by a household whose adjusted income does not exceed 80% of the area median income (AMI), and cost of rent, heat, and utilities not exceeding 30% of the gross annual household income for a household with 80% or less of AMI.
- Ensuring that any other provisions contained in the relevant chapter that reasonably relate to affordable housing compliance and enforcement are met.
