Summary
- Requires local governments to allow development of certain affordable housing on lands not zoned for residential uses.
- Restricts development on land zoned for industrial use to properties that are publicly owned and adjacent to lands zoned for residential use or school use.
- Prohibits development on lands designated for heavy industrial use.
- Amends period in which housing units must remain affordable from 40 years to 30 years.
- Allows establishment of certain affordable housing at increased density.
- Residential properties are considered affordable housing when three conditions are met: each unit is affordable to families earning 80 percent of the area median income, the average of all the units is affordable to families earning 60 percent of the area median income, and the units remain affordable for no less than 60 years.
- Allows applicants to obtain attorney fees in prevailing appeals before the Land Use Board of Appeals (LUBA).
