Summary
- Clarifies that a governing body may only exercise planned unit development powers if it has enacted an ordinance related to such development.
- Allows governing bodies to reduce the minimum site area for planned unit development to fewer than 5 acres.
- Allows governing bodies to eliminate parking minimums for each dwelling unit.
- Requires that enforcement and modifications of unit development plans not impair the reasonable reliance of residents and owners upon the plan or result in changes that would adversely affect the public interest. This removes the requirement that enforcement and modifications of unit development plans further the mutual interest of residents, owners, and the public.
