Summary

  • Authorizes developers to apply for approval of “small home lot developments” subject to streamlined standards. Developments must be located on parcels no larger than five acres that are substantially surrounded by qualified urban uses and zoned for multifamily residential use. Developments must meet minimum unit thresholds and consist of single-family units with an average total floor area of 1,750 net habitable square feet or less.
  • Small home lot developments must comply with existing multifamily height and setback standards applicable to the site and any local inclusionary housing ordinances. Developments are prohibited on sites that would require demolition or alteration of specified protected housing types and on sites identified in the jurisdiction’s housing element to accommodate regional housing needs for low-income or very low income households. Subdivisions are prohibited if they would require demolition of protected housing.
  • The bill limits local government discretion by prohibiting imposition of setback requirements between units within the development, minimum lot size requirements for individual lots within the development, and specified parking requirements. Local agencies must approve applications for small home lot developments unless they make a specified finding.
