Summary

  • Prohibits a municipality, city, or town from adopting or imposing new single-family residential building design elements, unless the structure is:
    • Located in a historic district.
      • Designated as a historic landmark.
      • Governed by regulation created by a negotiated zoning ordinance.
      • Governed by a policy, regulation, or ordinance affecting public safety.
      • Governed by a policy or regulation within a tax increment finance district or a business improvement district.
      • Governed by a policy or regulation of an overlay or special purpose zoning district.
      • Located in a blighted area or redevelopment district.
    • Exempts regulations related to safety, manufactured housing, or related to compliance with the National Flood Insurance Program.
    • Exempts regulations created by private covenants or other contractual agreements among property owners, including declarations maintained by owners’ associations.
    • Defines “residential building design elements” to include type or style of exterior cladding, roofing, the number and types of rooms, and the minimum square footage of a structure. Such design elements do not include height, bulk, orientation, or location of a structure on a lot or buffering or screening elements located at the perimeter of the property.
