Summary
- Prohibits local development policies, standards, or conditions that would: downzone or reduce land use intensity below what was in effect on January 1, 2018; impose housing development moratoriums; impose non-objective design standards after January 1, 2020; or establish permit or population caps (unless approved before January 1, 2005 in a predominantly agricultural county.
- Prohibits approval of housing developments requiring demolition of residential units unless the project replaces at least as many units as are demolished, with relocation assistance and right of first refusal for displaced occupants.
- Requires housing development projects to be subject only to ordinances, policies, and standards in effect when a preliminary application is submitted.
- Caps public hearings at 5 for housing development projects that comply with applicable objective general plan and zoning standards.
- Reduces EIR approval timelines from 120 to 90 days generally, and from 90 to 60 days for projects meeting affordability conditions.
- Applies to all cities including charter cities; sunsets January 1, 2025.
